Legality of a home-made 200mw or more laser "pointing" device?

I currently live in the United States in the state of Alabama. I am wanting to remove a laser diode from a old dvd drive and use it to create my own laser "pointing" device. I do not plan on using it as an actual laser pointer though. I wish to use it as a "toy" or in other words, I want to use it for burning objects. What is the legality of doing this?

and if you manage to blind someone (200mW can do that) you can get sued
