Should my vehicle pass the Virginia state inspection?

The Manassas Jeep dealer who inspected my Jeep is refusing to "pass" it unless I purchase a new LED third brake light assembly for $60. This is a high mount brake light bar with seven diode sections that are supposed to light up, and the problem is that one of the sections on my light bar won't light up. The other six sections do light up. From a few feet away it is very well lit and you can not tell that it is partly unlit. Was this a legitimate reason to fail the Virginia state vehicle inspection?
I found the Rules and Regulations for the VA state police safety inspections, and in the section that covers stop lamps, it states:

"For those vehicles that are equipped with a multiple LED light (not filament burning bulbs), they will pass inspection if 50% of the diode lights are burning"

Doesn't this apply to my situation? Six out of seven of my diode lights work.
